Public Offer and Personal Data Processing Policy

General provisions

These terms of use for en.axiompro.ru (the Website) determine the rules for using Website materials and the procedure for processing users’ personal data. The Website belongs to and is administered by Trading House KUDO LLC (ООО «Торговый дом „КУДО“»), Russian Tax ID 5031138801 (the Company). Continued use of the Website constitutes the visitor’s full acceptance of the terms below. A user who does not accept these terms must stop using the Website.

The Company may change the Website content and these terms, including legal information, at any time without prior notice. Visitors are advised to review the current version periodically. All materials on the Website are protected by intellectual-property law; unauthorised use may violate the laws of the Russian Federation.

The original public offer and personal data processing policy are provided in Russian. This English version is a translation for convenience. If the versions differ, the Russian-language version takes precedence.

Product information on the Website

All information on the Website, including information about AXIOM® products, their characteristics, and configurations, is provided solely for reference. The materials may contain inaccuracies, typographical mistakes, and other errors and may not be complete, current, or exhaustive. The Website administration does not guarantee the accuracy or completeness of the information.

For accurate and current product information, please contact Company representatives directly using the details in the relevant section of the Website.

Product and service materials on the Website do not constitute a public offer or an invitation to make an offer within the meaning of Article 437 of the Civil Code of the Russian Federation. Website information does not represent sales or service terms binding on the Company. As orders cannot be placed through the Website, product descriptions are reference materials and cannot be regarded as exhaustive or guaranteed to be accurate.

Personal Data Processing Policy

The Company collects and processes Website users’ personal data in accordance with the laws of the Russian Federation, including Federal Law No. 152-FZ “On Personal Data”. Personal data is processed lawfully and fairly and only for purposes connected with operation of the Website and interaction with users.

Users provide personal data voluntarily, for example when completing feedback or enquiry forms or adding comments or product questions.

Personal data a user may provide includes, without limitation: surname, first name, and patronymic; email address; contact telephone number; organisation and city; selected product; and other information the user provides about themselves, such as an enquiry, question, or comment. A form submission may also record the IP address, browser User-Agent, submission date and time, and technical anti-automation indicators.

By selecting the consent checkbox and submitting a Website form, a user accepts this Policy and authorises the Company to process the supplied personal data under its terms. Processing begins when the form is submitted.

A user may withdraw consent to personal data processing at any time by sending a request to axiom@kerry.ru. The Company’s postal address is 24/48 Otkrytoye Shosse, Moscow, 107143, Russia.

Purposes of personal data processing

The Company processes personal data only for the purposes for which it was supplied, including: establishing contact with a user and responding to requests, questions, or comments; providing requested information about Company products and services; publishing a user’s review, comment, or question on the Website where the user submitted that material and consented to its publication; improving Website quality, analysing user enquiries, and improving ease of use; and sending advertising or news information, such as information about new products or promotions, but only where the user has separately consented to receive such messages.

Personal data is processed by automated and non-automated means. The Company may perform operations including collection, recording, organisation, accumulation, storage, correction or updating, retrieval, use, transfer by provision or access, anonymisation, restriction, deletion, and destruction.

All personal data is stored in protected systems of the Company or its authorised technical partners using necessary safeguards. The Company warrants that users’ personal data is processed in accordance with applicable Russian law and only for the stated purposes.

The Company does not disclose or disseminate personal data to third parties without the data subject’s consent, except where expressly required by law, where data must be supplied in response to a lawful request from an authorised state authority, or where data is provided to an authorised technical partner to the extent necessary to operate the Website and communicate with the user.

Retention and publication of questions

Product-question data, including the name, email address, question, selected product, IP address, User-Agent, and submission date, is retained without a predetermined time limit while the question-and-answer knowledge base remains in use, or until consent is withdrawn where there is no other lawful ground for continued processing. Other enquiry data is retained for as long as necessary to respond, maintain business correspondence, protect the Company’s rights, and meet Russian legal requirements. Backup copies are removed as part of their scheduled rotation.

After moderation, the question, the Company’s answer, and the name supplied by the author may be published on the Website. The email address, IP address, and User-Agent are not published. Users should not include information in a question that they do not want to make public.

Use of cookies and similar technologies

The Website uses cookies and similar browser storage technologies to ensure its operation, save user settings and, where the user has consented, collect statistical information about visits to the Website.

Cookies are small pieces of data stored by the browser on the user’s device. They may be used, for example, to save selected settings, enable certain Website functions, and remember the choice made by the user regarding the use of analytics technologies.

Cookies may be session cookies, which are stored only for the duration of a browser session, or persistent cookies, which remain on the user’s device for a specified period or until the user deletes them.

Essential cookies

Essential cookies are used for the correct and secure operation of the Website and are not intended to collect website-traffic statistics or create advertising profiles.

They include, in particular:

  • axiom_cookie_consent — stores the user’s choice regarding analytics: “analytics allowed” or “essential only”. Its retention period is 180 days;
  • CSRF cookie — protects forms and requests on the Website against cross-site request forgery (CSRF). Its retention period is determined by the technical settings of the Website and the user’s browser.

Essential cookies may be set without enabling analytics services because they are required for the operation and security of the Website and to save Website settings.

Analytics technologies

The Website uses Yandex Metrica to obtain statistical information about Website traffic.

Yandex Metrica may use cookies, browser local storage (localStorage), and other technical identifiers to obtain statistical information, including information about visits to the Website, pages viewed, referral sources, and user interactions on the Website.

Yandex Metrica is used only after the user has given express consent to analytics.

Merely visiting or continuing to use the Website does not constitute consent to the use of analytics technologies.

Before the user gives consent, the Yandex Metrica counter code is not loaded, analytics cookies and local-storage entries related to Metrica are not created by the Website, and information about the visit is not transmitted through Yandex Metrica.

User choice

On their first visit to the Website, the user may:

  • allow analytics;
  • select “Essential only”.

Refusing analytics technologies does not restrict access to the main functions or content of the Website.

The user’s choice is stored in the axiom_cookie_consent cookie for 180 days, after which the Website may ask the user to make the choice again.

Changing and withdrawing consent

The user may change a previous choice or withdraw consent to analytics technologies at any time by using the “Cookie settings” button in the Website footer.

When consent is withdrawn, the Website stops the subsequent loading and operation of Yandex Metrica and deletes analytics cookies accessible to the Website and browser local-storage entries associated with Metrica.

Withdrawal applies to subsequent use of analytics technologies and does not automatically affect information that was lawfully processed before consent was withdrawn.

Managing cookies in the browser

The user may also restrict or completely disable cookies in their browser settings and delete previously stored cookies and local-storage data.

Disabling essential cookies may cause certain Website functions to operate incorrectly, including forms, security mechanisms, and the saving of user settings.

Intellectual property

All items on the Website, including texts, descriptions, illustrations, photographs, design, audio and video materials, and software code, are protected intellectual property. Exclusive rights in these materials belong to Trading House KUDO LLC unless expressly stated otherwise. In particular, the rights holder owns the AXIOM® trademark and other Company branding.

Materials created by third parties and placed on the Website with the rights holders’ permission, such as partner logos and third-party trademarks, belong to their lawful owners. Any use of Website materials without the rights holder’s prior written permission is strictly prohibited.

Use includes copying, reproduction, adaptation, distribution, display in any form, publication, translation, and any other exploitation beyond personal review. Unauthorised use of Website content may result in liability under applicable law, including copyright and trademark law.

Permission to use Website materials must be requested directly from the Company.

Disclaimer

The Website and all materials on it are provided “as is”, without express or implied warranties. The Company does not guarantee error-free or uninterrupted Website operation, that materials will meet users’ expectations, or that information will always be current and up to date.

The Website administration will make reasonable efforts to keep the information current and the resource operational, but is not responsible for the accuracy, completeness, or currency of Website information.

Trading House KUDO LLC as Website administrator, its affiliates, partners, and suppliers will not be liable for direct or indirect loss, lost profit, lost opportunity, or other loss arising from the use of Website materials or inability to use the Website.

In particular, the Company is not responsible for damage caused by user actions based on Website information or for the consequences of technical failures, temporary unavailability, user data loss, or other technical access problems. Users access the Website and its information at their own risk.

For user convenience, the Website may link to web pages or resources of third parties, such as distributors, partners, or social networks. Such links are provided for information only. The Company does not control third-party resources and is not responsible for their content, availability, or compliance with law.

When a user follows an external link, they leave the Company’s Website and further interactions are governed by the terms of use and privacy policy of the relevant third-party resource.

Applicable law: the laws of the Russian Federation. All disputes are subject to judicial resolution at the Company’s location.

Final provisions: if any provision of these terms is invalid or unenforceable, the remaining provisions remain valid. The Company’s failure to demand strict performance of a provision does not constitute waiver of the relevant right. The current Public Offer and Personal Data Processing Policy is available to users on the Website and updated as necessary.

By using the Website after changes are made, the user confirms acceptance of the revised terms.
